Privacy Policy
This privacy policy (“Privacy Policy”) governs your use of the RentCast website, online platform and application programming interface (collectively, the “Application”), created and maintained by Fortnoff Financial LLC (“We”, “Us” or “Our”).
Personally Identifiable Information
The Application collects and stores personally identifiable information you provide as part of the account creation and management process, including, but not limited to, your email address and any name, contact or branding information you choose to provide (“Personally Identifiable Information”). We may use the Personally Identifiable Information you provide to operate, maintain, support and improve the Application, and to contact you from time to time with news, important updates, required notices and marketing promotions. Payment information is collected and processed by third-party payment service providers, and We do not directly store complete payment card information.
Non-Personally Identifiable Information
The Application may collect and store non-personally identifiable information you provide as part of the normal use of the Application, including, but not limited to, real estate property addresses, descriptions and photographs, investment property selection criteria and other Application settings (“Non-Personally Identifiable Information”). We may use the Non-Personally Identifiable Information you provide to operate, maintain, support and improve the Application, troubleshoot issues related to your use of the Application and, in aggregate (not at the user level), provide Us and Our affiliates, partners or other third parties with Application usage statistics.
Automatically Collected Information
The Application may collect and store certain information automatically, including, but not limited to, the type of device you use, your device’s unique identifier, where available, the IP address of your device, your operating system, the type of web browser you use and information about the way you use the Application (“Automatically Collected Information”). We may use the Automatically Collected Information to operate, maintain, secure, support and improve the Application, troubleshoot issues related to your use of the Application and, in aggregate (not at the user level), provide Us and Our affiliates, partners and third parties with Application usage statistics.
Location Information
We may use browser or device location services to determine your current location in order to display it on the map within the Application. We do not store or share your current location with other users, Our affiliates, partners or other third parties. If you do not want Us to use your location for the purposes set forth above, you can turn off location services for the Application through your device or browser settings.
Cookies and Similar Technologies
We may use cookies, browser local storage and other similar technologies (“Tracking Technologies”) to operate, customize and improve the Application and your experience using it. Tracking Technologies may be used for purposes including, but not limited to: (i) identifying you and accessing information associated with your use of the Application; (ii) saving login sessions, preferences and other settings so that you do not have to re-enter them each time you use the Application; (iii) providing features and functionality of the Application; (iv) maintaining security and preventing fraud or abuse; (v) analyzing Application usage, user activity and usage patterns; and (vi) providing content, products, services or promotions that may be relevant to your interests. Tracking Technologies may store or access small amounts of data on your device or within your web browser. You may control certain Tracking Technologies through your browser settings and any other controls We make available through the Application.
Sharing of Information with Third Parties
We collect, use and disclose information in accordance with applicable privacy and data protection laws. We may share your Personally Identifiable Information, Non-Personally Identifiable Information and Automatically Collected Information (collectively, “Collected Information”) with Our affiliates, partners, service providers or other third parties in the ways described as follows: (i) as required by law, such as to comply with a subpoena or similar legal process; (ii) when We believe in good faith that disclosure is necessary to protect Our rights, protect your safety or the safety of others, investigate fraud or abuse, or respond to a government request; (iii) if Fortnoff Financial LLC is involved in a merger, acquisition, reorganization, or sale of all or a portion of its business or assets; (iv) to provide Our affiliates, partners or other third parties with Application usage statistics, in which case the Collected Information will only be shared in aggregate (not at the user level); and/or (v) as reasonably necessary to operate, maintain, support and provide the functionality of the Application, communicate with you, and provide services through third-party service providers, including, but not limited to, processing payments. We may also use Collected Information to provide marketing and promotional communications to you as described in this Privacy Policy.
Data Storage and Handling
The Application may store and process Collected Information on your device and/or through third-party cloud hosting, data storage and other service providers selected by Us. We may use such third-party service providers to store, process and otherwise handle Collected Information in connection with the operation of the Application. While We take reasonable measures in selecting and using such providers, no method of data storage, transmission or processing can provide absolute security or prevent all potential security breaches.
Data Retention
We retain Collected Information for as long as reasonably necessary to provide and operate the Application, fulfill the purposes described in this Privacy Policy, comply with legal and accounting obligations, resolve disputes, prevent fraud or abuse, enforce Our agreements and maintain appropriate business records and backups. You may request deletion of Collected Information you have provided through the Application by contacting Us at support@rentcast.io, subject to applicable legal, security, billing, fraud-prevention, recordkeeping and backup-retention requirements.
Security
We use reasonable administrative, technical and organizational safeguards designed to protect the confidentiality and security of Collected Information. We take reasonable measures to limit access to Collected Information to authorized employees, contractors and service providers who require such access to operate, maintain, support or improve the Application. These safeguards are designed to reduce the risk of unauthorized access, disclosure, alteration, loss or misuse of Collected Information.
Your Choices
You may stop additional collection of Collected Information through your use of the Application by ceasing to use the Application. You may also control certain Tracking Technologies and location information through your browser or device settings, as described above. You may request deletion of Collected Information you have provided through the Application by contacting Us at support@rentcast.io, subject to the retention requirements and limitations described in this Privacy Policy.
Property Owner Information Non-Disclosure Requests
Parts of the Application may display personally identifiable information of real estate property owners as part of the normal use of the Application, including, but not limited to, real estate property owner names and mailing addresses (“Property Owner Information”). If you would like Us to redact or otherwise not disclose Property Owner Information pertaining to you, or if you are authorized to make such a request on behalf of another person, you may submit your request in writing by emailing Us at support@rentcast.io and providing the Property Owner Information you would like Us to redact or otherwise not disclose. We may request information reasonably necessary to verify your identity, your authority to make the request and the Property Owner Information subject to the request. We will review and process all such requests within the timeframe required by applicable law or otherwise within a reasonable time. Any redaction or non-disclosure applies to the Application and databases controlled by Us and does not modify the underlying public records or third-party source databases from which the Property Owner Information may have originated. You may request confirmation that your redaction or non-disclosure request has been processed by contacting Us at support@rentcast.io.
Children
The Application is not directed to children under the age of 13, and We do not knowingly collect Personally Identifiable Information from children under the age of 13. If a parent or guardian becomes aware that their child has provided Us with such information without their consent, they should contact Us at support@rentcast.io. We will take reasonable steps to delete such information, subject to applicable legal, security, recordkeeping and backup-retention requirements.
Your Consent
By using the Application, you acknowledge and agree to the collection, use, processing and disclosure of your Collected Information as described in this Privacy Policy. For purposes of this Privacy Policy, “processing” includes, but is not limited to, collecting, using, storing, combining, transferring, sharing, disclosing and deleting information. Collected Information is generally processed and stored in the United States, but may also be processed or stored in other jurisdictions where Our service providers operate.
Changes
We may update this Privacy Policy from time to time for any reason. We will notify you of any changes by posting the updated Privacy Policy on this page. Any such changes will become effective upon posting, and your continued use of the Application after the updated Privacy Policy is posted will constitute your acceptance of the changes.
